Five-Year Review of Florida's Felony Theft Threshold Dollar Amounts

Report Summary

 

  • Florida is one of 12 states with felony theft thresholds under $1,000; 38 states have felony theft thresholds of $1,000 or more (Texas and Wisconsin have the highest felony thresholds of $2,500 or more). Since 2019 seven states, including Florida, have amended their felony theft threshold.
  • Over the past 10 years, arrest and convictions have declined for both misdemeanor and felony thefts in Florida. The decline in theft arrests in Florida is similar to national trends. Findings suggest that adjustments to the felony theft thresholds in 2019 had no noticeable impact on overall theft arrests.
  • Using the Consumer Price Index (CPI) rate of inflation from the enactment date of the most recent change to Florida’s felony theft threshold of $750 in October 2019 to the most recently available CPI data in June 2024, the estimated inflationary adjustment would be an additional $166 (from $750 to $916).
  • OPPAGA provided options for the Legislature to consider should it wish to amend the statutory theft thresholds. Options include leaving the current threshold amount in place or using the CPI rate of inflation to guide any future changes to the felony theft threshold.
