What is the purpose of the division?

The Department of Financial Services' Division of Funeral, Cemetery, and Consumer Services protects death care industry consumers purchasing preneed burial rights as well as those purchasing funeral and burial merchandise or services.  It also oversees licensed establishments, facilities, and cemetery grounds by conducting annual inspections.

What services are provided by the division?

The division oversees licensed establishments, facilities, and cemetery grounds by conducting annual inspections and has established qualifications for professions and occupations in the death care industry.  These professions and occupations include but are not limited to funeral directing, embalming, preneed sales and monument sales. The division also ensures death care professionals maintain their qualifications through continuing education courses and licensure renewal and ensures effective discipline for those licensees who have violated the law.

What types of licenses are offered?

State law provides for several licenses for death care businesses and professionals, including embalmers, funeral directors, funeral homes, and cemeteries. Individuals may obtain forms and other licensing information from the division's website.

How effective is the division in performing its functions?

The division currently regulates 9,840 death care industry licensees of various types. The division has the authority to conduct investigations, financial examinations, and inspections of applicants and licensees. For Fiscal Year 2018-19 the division cited 40 entities for disciplinary action. Consumers may access current lists entities under disciplinary action through the website.

Updates

The Division of Funeral, Cemetery, and Consumer Services has issued several notices regarding the 2020 Covid-19 pandemic.

  • Personal Protective Equipment. Many businesses licensed under Ch. 497, Florida Statutes, may now request various forms of personal protective equipment from the state's Division of Emergency Management. 
  • Temporary Suspension of Key Statutes and Rules. Chief Financial Officer Jimmy Patronis has executed the CFO Directive 2020-08. The directive promotes public health and safety by suspending the s. 872.03, Florida Statutes, which imposes 48  hour waiting period before human remains may be cremated. The directive also suspends administrative rules limiting funeral establishments to using cremation, refrigeration, embalming, or removal services located less than 75 miles away. The directive also grants the division the authority to approve limited licenses for retired professionals who were once licensed, in any state, as a funeral director, embalmer, combined funeral director an embalmer, or direct disposer. 
  • Extension of Licensure and Reporting Deadlines. The CFO has issued a directive which extends several April 1, 2020 deadlines to June 1, 2020.  A list of applicable licensees is available on the division website. Also, all active and valid preneed licenses are extended until August 31, 2020.
