What is the purpose of the office?

The Office of the Attorney General, Department of Legal Affairs, provides a variety of legal services, including defending the state in civil litigation cases; representing the people of Florida in criminal appeals in state and federal courts; protecting consumers from various types of fraud; conducting various programs to assist crime victims; and prosecuting some criminal offenses.

The Florida Constitution designates the Attorney General as the chief state legal officer. The constitution requires the Attorney General to be elected every four years and be at least 30 years old. To qualify for election, the Attorney General must have resided in the state for the preceding seven years and have been a member of the Florida Bar for the preceding five years. The Attorney General serves as a member of the Florida Cabinet.

What activities are performed by the office?

The office's activities include the following.

  • Antitrust Division brings actions against individuals or entities that commit state or federal antitrust violations, such as bid-rigging, price-fixing, market or contract allocation, and monopoly related actions.
  • Civil Litigation Division provides statewide representation on behalf of the state of Florida, its agencies, officers, employees and agents, at the trial and appellate levels.
  • Office of Civil Rights files civil actions for damages and injunctive relief on behalf of the State under the Florida Civil Rights Act of 1992 in cases involving a pattern or practice of discrimination or in cases involving discrimination constituting an issue of great public interest. The office works with the Florida Commission on Human Relations and other groups to enforce the provisions of the Florida Fair Housing Act.
  • Consumer Protection Division protects Florida consumers and businesses by pursuing individuals and entities that engage in deceptive or unfair practices in any trade or commerce. Serves as the civil enforcement authority for all multi-circuit violations of the Florida Deceptive and Unfair Trade Practices Act.
  • Criminal Appellate Division defends all direct criminal appeals and post-conviction appeals in the state appellate courts and defends state judgments and sentences in post-conviction matters throughout the federal district and appellate courts in all federal habeas corpus litigation.
  • Division of Victim Services and Criminal Justice Programs provides services to crime victims and educates the public about crime prevention. The division administers the Crimes Compensation Trust Fund and the State's federal grant under the Victims of Crime Act.
  • Office of Statewide Prosecution investigates and prosecutes multi-circuit criminal activity and assists state and local law enforcement in their efforts to combat organized crime.
  • Florida Elections Commission and Florida Gaming Control Commission reside within the Office of the Attorney General for administrative purposes. Neither commission is subject to the control of the Attorney General.
